Oscar-winning actor Sean Penn has filed for legal separation from his wife of 13 years, actress Robin Wright Penn, according to TMZ.com.

The celebrity gossip site said that Sean Penn filed papers last week in Marin County, Calif., Superior Court, citing "irreconcilable differences."

Sean Penn is asking that the each party pay for their own attorneys, and is requesting that the judge to terminate the court's power to award Robin Wright Penn spousal support.

They have two children, Dylan, 18, and Hopper, 15.

Sean Penn, 48, and Robin Wright Penn, 43, had announced in December 2007 that were going to divorce, but got back together four months later.

The actor divorced his first wife, singer Madonna, in 1989 after four years of marriage. Robin Wright Penn's first marriage, to actor Dane Witherspoon, ended in 1988 after two years.

A two-time Oscar winner, Sean Penn most recently won for Best Actor in February for playing gay politico Harvey Milk in "Milk." He won his first Best Actor Oscar for the 2003 film "Mystic River." He will next play Larry Fine in "The Three Stooges" next year.

Robin Wright Penn has starred in such films "The Princess Bride," "Forrest Gump," "Beowulf" and most recently, filmed an introduction to the documentary, "Haze." She currently co-stars in the drama "State of Play" and will next star in a motion-captured version of "A Christmas Carol."
